Publication of the instruction concerning the issue of the residence document for UK nationals
- The document demonstrating residency can be requested as of 6 July and family members of these nationals will also be able to benefit from this new measure
The Ministry of Inclusion, Social Security and Migration, through the Secretary of State for Migration, together with the Ministry of the Interior, through the Secretary of State for Security, have signed an Instruction, published on 4 July in the Official State Gazette, determining the procedure to be followed for the issue of the residence document as provided for in article 18.4 of the Agreement on the Withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community.
This agreement details the documentation process for British citizens residing in a member state of the Union for the purposes of differentiating between those exercising their right to free movement before 31 December 2020 and those arriving after said date. The former will benefit from the rights of residency, free movement and Social Security expressly recognised in the Withdrawal Agreement.
With the publication of this order it establishes a documentation procedure for citizens of the United Kingdom residing in Spain as well as for their family members in accordance with the Withdrawal Agreement negotiated between the United Kingdom and the European Union.
The procedure will be operational as of 6 July 2020 and distinguishes between those that already have a registration certificate or residence card for family members of EU nationals and those who do not.
